From May 1, 2007, the intent of Jasmine & Kevin Butt and Barron Casteel was to force me to turn over a Title to my home while concealing a FOUNDATION REPORT which was procured by the Butts, prior to my signing of the Contract wit them. The FOUNDATION REPORT, which the Butts themselves told me about but NEVER SHOWED ME, proved that the foundation of my home was UNSAFE for habitation.
Barron Casteel's only interest in the BUTTS was a self-interest. From the first day of his representation of them, he advised them to lie in their allegations. The Butts never had a chance, therefore, of legally BUYING MY HOME. From the first moment, Barron Casteel advised them to HIDE THE EXPERT FOUNDATION REPORT!
On April 28th and 29th, 2007, the Butts, having failed to persuade Ashley Thietgard, a Loan Processor at 1st American Title, to FORCE ME TO SIGN A DOCUMENT, extending the stipulated CLOSING DATE, 4/30/2007, for another period of time---the Butts began frantically faxing a "document" to the grocery food store in Canyon Lake, TX. requiring that I COME TO THE GROCERY STORE, SIGN IT, AND SEND IT BACK!
Of course, I never responded to the Butts' insistence that I extend the Closing Date because, by the week-end before the Closing Date, I had already heard from the Butts, themselves, that they had A FOUNDATION INSPECTION REPORT SHOWING SERIOUS FOUNDATION REPAIRS WERE NECESSARY. Additionally, Jasmine Butt had called an attorney who had helped me previously, Jerry Tucker, and DEMANDED that I must pay for the FOUNDATION INSPECTION and extensive REPAIRS that the Butts demanded OR THEY WOULD SUE ME.
I had already determined that my only legal course of ACTION was to terminate the Contract and get my own Foundation Inspection Report. Therefore, on 4/30/07, I showed up at 1st American Title (although Ashley Thietgard had already called off the Closing that day because the Butts had NOT been able to compile a LIST of repairs still necessary - for which I could place money in ESCROW). I obtained a Form from 1st American Title, "TEXAS ASSOCIATION OF REALTORS, Termination of Earnest Money Contract and Release of Earnest Money," and sent it to the Butts so that they could get their Earnest Money back from 1st American Title.
The Butts, however, never allowed me to terminate the Contract in any Legal manner. Barron Casteel's "legal advise" to them was to perjure themselves, lie about the EXPERT FOUNDATION REPORT, and pursue me for failing to PERFORM --- that is: for many months the Butts and Casteel tried diligently to FORCE THE CONTRACTOR-under Contract with me- WHO WAS DOING THE ROOF REPAIR and other repairs TO WORK IN THE RAIN. Finally, that Contractor stopped taking phone calls from the Butts and Casteel and - walked off the job for me- NEVER TO RETURN.
By September, 2007, a Mediation was attempted with the Butts and Casteel. However, the Mediator, Bob Bowman, was UNABLE to make any agreement AT ALL. He apologized to me and left - with no further agreement. From that time, forward, I always relied on the fairness of a Jury Trial. It was the ONLY HOPE that I had of ever being able to sell my home, honestly, to another Buyer.
